Abstract

This study addresses the nature of the institution of pretrial detention as a precautionary measure that, by depriving a person of their liberty before determining their guilt, generates tensions with the guarantee-based principles of criminal procedure and can hinder rehabilitation. Despite its exceptional nature, this practice has become common in various legal systems, sparking debate about its legitimacy and the need to establish clear restrictions on its application. In this context, the research aims to implement a neutrosophic method to evaluate multidisciplinary strategies for motivating and reintegrating pretrial detainees into society. Tactics that enhance individuals' motivation and foster their social reintegration will be analyzed, considering both the personal rights affected and the psychological, social, and legal factors that impede change and rehabilitation. Furthermore, it will question whether the current use of pretrial detention contributes to criminal justice or, on the contrary, limits access to effective rehabilitation programs. This research motivates comprehensive actions that balance the protection of human rights and social interests, transforming preventive confinement into a process of positive transformation that improves the circumstances of those facing this situation.
