Abstract

This article carries out a study on the normative ineffectiveness of applying the mechanisms of comprehensive reparation of nature as a subject of rights along with the conceptualization of the indigenous worldview of the Sumak Kawsay. Important aspects are revealed such as the existence of legal and technical gaps to make comprehensive reparation effective and, on the other hand, political, judicial and educational anthropocentrism in the conceptualization of the rights of nature, through legal, doctrinal analysis. , hermeneutical and bibliographical. The research aims to develop a method for evaluating the ineffectiveness of the norm in the application of comprehensive reparation mechanisms in the rights of nature.
