Abstract

National and international legislation recognizes the right of every citizen to effective judicial protection of their rights, and this implies being judged by impartial judges, which constitutes true protection of the right to defense. The administration of justice must respect the principles, rights and guarantees established in the Constitution, international treaties, and other provisions of the legal system. The objective of this research is to propose a method to evaluate the universal right of citizens to be judged by impartial judges. This proposal was implemented using expert criteria based on the Neutrosophic Delphi method. As a result of the application of the method, a high importance is obtained of the need to be judged by impartial judges. In addition, a systematization of the arguments and the importance of the principle of impartiality for a correct defense of people's rights is carried out; because being a Judge implies applying law and justice in each specific case; He must be a person with impeccable conduct and strict respect for the rules and the administration of justice.
