Abstract

This research analyzes International Humanitarian Law (IHL) as a protector of rights in internal conflicts in Ecuador. Thus, individual criminal responsibility, civil protection in internal conflicts and the presence of non-state armed actors linked to drug trafficking are discussed. Given the current social situation in Ecuador, this research aims to develop a multi-criteria neutrosophic method to evaluate humanitarian law as a guarantee of protection of rights in a state of internal war against crime. The method allows for the timely detection of human rights violations during the state of emergency. Based on the results obtained by the implemented neutrosophic method, actions are proposed such as strengthening state capacities and adapting IHL approaches; given that international cooperation and strengthening the rule of law are essential elements.
