Neutrosophic multicriteria evaluation of the rights of nature in legal proceedings before the Constitutional Court of Ecuador

Abstract

Having recognized nature as a subject of rights in Ecuador since the Constitution of 2008, is a means that allows activating some mechanism for the effective fulfillment of its rights, for this it is necessary to have a representation, on which the constituent considered that it should be through an open legitimation. Therefore, in this research a method is developed for the multicriteria neutrosophic evaluation of the rights of nature in judicial processes before the Constitutional Court of Ecuador. To nourish the method it was necessary to determine who has represented nature in judicial processes that have been known to the highest constitutional body of Ecuador. In addition, the role that the Ombudsman has played in fulfilling its purposes and powers in favor of the rights of nature. It was possible to show that in 67% of the cases analyzed, nature was represented by individuals, and in none of them did the Ombudsman have a participation destined to its representation.
