Abstract

In this research a study was carried out to legally analyze the crisis of the penitentiary system in Ecuador and its impact on fundamental rights. In the main, a legal and doctrinal analysis of the causes and factors that have provoked the last massacres in Ecuador's prisons was carried out. A study framed in the paradigmatic modality or quali-quantitative approach was carried out, affirmed under the types of descriptive research of transversal type. On this basis, theoretical, empirical and mathematical-statistical methods were identified. Those that contributed to the development of the research. We also used scientific techniques. Once these were applied, it was possible to contact the level of validity of the research, as well as the future lines of research.
