Neutrosophic method to evaluate the right to resistance from social protest
Main Article Content
Abstract
A Constitutional State of Rights, manages the right to resistance and social protest within its legal framework. However, evaluating the right to resistance from social protest constitutes a highly sensitive task. The objective of this research is to develop a method to evaluate the right to resistance from social protest. The proposed method uses a multi-criteria approach using Delphi with neutrosophic numbers in its processing. A qualitative approach is used and several scientific methods have been used, including deductive - inductive, synthetic analytical, documentary analysis and legal exegetical, based on bibliographic - documentary, field and applied research. To collect data, a semi-structured interview was conducted with experts in constitutional law. The main results revealed that the right to resistance is not clearly defined in the Constitution; on the contrary, it falls into ambiguity and that social protest is not explicitly recognized as a right in any national or conventional regulations.
