Neutrosophic method for the analysis of the Empre-sa Pública Mancomunada del Trópico Húmedo against the responsibility for contamination of the Toachi River

Abstract

This study aims to implement a Neutrosophic Method to analyze the responsibility of the Empresa Pública Mancomunada del Trópico Húmedo (EPMTH) in the contamination of the Toachi River, based on the violation of the rights of nature and of the inhabitants of the Brasilias sector of Toachi. According to articles 10 and 71 of the Constitution, nature is a subject of rights; however, recent evidence derived from the slaughter of pigs and cattle at Km. 14.5 of Las Mercedes road, Santo Domingo, has shown that, despite the existence of constitutional actions to safeguard the right to a dignified life of the inhabitants, the affectation of the rights of nature is ignored. This omission is reflected in the anthropocentric approach of the judicial decisions that exclude the Ombudsman's Office as a representative of nature, which compromises environmental sustainability and the well-being of present and future generations, as well as the local flora and fauna. Additionally, the ineffectiveness of the control authorities, specifically the Environmental Management Directorate of the Provincial Government of Santo Domingo, and the lack of adequate public policies to protect the rights of nature and its components in the region are highlighted. This context justifies the need for a deeper and more holistic analysis through the Neutrosophic Method to address these complex problems.
