Neutrosophic multicriteria method for the evaluation of the execution of labor sentences in relation to the right of access to justice and the principle of celerity in Ecuador

Abstract

The research focused on a normative analysis on the execution of labor rulings in Ecuador, within the general procedural framework contained in the General Organic Code of Processes (COGEP) given that the country does not have a labor procedural code. The research proposed a multi-criteria neutrosophic method for the evaluation of the execution of labor judgments. The research was carried out under a mixed approach resulting from the documentary review of books, scientific articles, legislation, processes and official documents; with the support of quantitative methods for mathematical modeling. With the analyzed processes it was evident that the rules for the execution of judgments in general are not practical for closing judicial cases that are processed from the perspective of Social Law; concluding that the legislature should in the future issue a Labor Procedural Code that materializes the real right of access to justice and procedural speed.
