Abstract

The research seeks to carry out an analysis of the judgments on alimony of the Provincial Court of Justice of Carchi, to determine whether the principle of the best interest of the child is adequately applied. The importance lies in that through a deep interpretation of these rulings, possible inconsistencies with national and international regulations on child protection can be identified. In this sense, a multi-criteria neutrosophic method was proposed for the evaluation of the judgments on alimony of the Provincial Court of Justice of Carchi. The results of the proposed method allow us to understand the broader meaning of these rulings, the interaction between the search for truth and legal fictions in the absence of evidence, as well as the effects of these decisions on the real life of children. The results help to nourish the rulings with updated doctrinal developments and to strengthen the application of the best interest of the child.
