Abstract

Historically, Ecuador has adopted a restrictive stance regarding abortion, with recent legal reforms expanding the grounds for decriminalization. This analysis focuses on assessing the restrictive interpretation of the legislation decriminalizing abortion in the country, examining its legal and social consequences. The main goal of this study is to analyze how this restrictive interpretation of the legislation affects effective access to legal abortion, recognizing the legal and procedural obstacles that hinder its implementation. This research proposes a method using Neutrosophic Cognitive Mapping to assess the restrictive interpretation of abortion decriminalization and its legal consequences. The findings demonstrate that this restrictive interpretation significantly restricts access to legal abortion, even in circumstances where the legislation authorizes it, due to procedural barriers, a narrow interpretation of the grounds, and the broad application of conscientious objection. In conclusion, this narrow interpretation of the law impedes the effective decriminalization of abortion, negatively impacting women's reproductive rights in Ecuador. This demands a thorough review of the legal framework to ensure full access to legal abortion.
