Neutrosophic method to evaluate the need to typify the crime of pornography and revenge in the Ecuadorian COIP
Main Article Content
Abstract
This article implements a Neutrosophic Method to evaluate the need to criminalize the crime of revenge porn in the Ecuadorian Comprehensive Organic Criminal Code (COIP). This new crime, of a sexual nature, seriously violates the privacy and personal, sexual, and psychological integrity of victims, in addition to compromising their personal freedom. Revenge porn is a growing social problem that must be addressed by the Ecuadorian justice system, since its lack of criminalization violates the right to privacy and sexual freedom of those who suffer from it. By proposing a draft reform to the COIP, the article focuses on the need to establish this crime as an aggravating factor, seeking to protect victims and guaranteeing their physical, sexual, and psychological integrity. The implementation of the Neutrosophic Method will allow for an objective and comprehensive evaluation of the feasibility of criminalizing this crime, thus contributing to the creation of a more just and effective legal framework that responds to the needs of victims and strengthens the justice system in Ecuador.
