Neutrosophic Multicriteria Method for the evaluation of revictimization in the crime of rape and its legal ef-fects in the criminal process in Ecuador

Abstract

Revictimization in sexual crimes is a global problem that significantly impacts criminal justice systems. Although Ecuador has a legal framework that protects victims' rights, revictimization persists in judicial proceedings. This analysis aims to implement a Neutral Multicriteria Method for assessing revictimization in the crime of rape and its legal effects on Ecuador's criminal proceedings. It examines the duty of rape victims to present themselves as specific accusers at trial and its effect on revictimization. The results of the Neutral Multicriteria Method show that the obligation to appear in court intensifies victims' suffering, forcing them to constantly relive traumatic experiences. Furthermore, a lack of sensitivity and adequate procedures on the part of judicial authorities exacerbate this problem. In Ecuador, the re-victimization of rape victims is a serious issue that requires amendment to Article 433, paragraph 6, of the Comprehensive Organic Criminal Code. This reform should focus on simplifying legal procedures and providing a more empathetic environment for victims, in order to reduce their suffering and ensure effective protection of their rights. This research proposes an innovative approach that could contribute to improving the current situation of victims in the Ecuadorian criminal justice system.
