Abstract
This article analyzes the theory of the Criminal Law of the Enemy, proposed by Günther Jakobs, and its application in the context of Ecuadorian criminal law. Through a mixed methodology that combines doctrinal and empirical analysis, the implications of adopting a punitive approach that distinguishes between citizens and enemies of the State are evaluated. This research proposes to develop a multicriteria neutrosophic method for the evaluation of the criminal law of the enemy and Ecuadorian criminal law. The proposed method bases its operation on a multicriteria approach to evaluation. Judicial cases and relevant legislation in Ecuador are examined to determine how these principles are reflected in legal practice and their impact on fundamental rights.
