This article examines the situation of migrant children in the context of constitutional rights, focusing on the importance of guaranteeing their right to education. This research proposes the development of a method to control the constitutional right to education for migrant children. The result is an analysis of the relevant international and national legal and constitutional frameworks, as well as the challenges and best practices in the implementation of inclusive educational policies for migrant children. It is argued that quality education for migrant children is not only a moral imperative, but also a constitutional right that must be protected and promoted by States.
